Terms of Use

This is a template terms of use describing how PostDeck currently operates. It has not been reviewed by a lawyer and should be replaced with reviewed legal copy, tailored to your school or organisation's obligations, before public launch.

1. Introduction and acceptance

These Terms of Use govern access to and use of PostDeck, a TeachSmarts product. By creating a teacher account, or by joining a session as a student, you agree to be bound by these terms. If you do not agree, do not use PostDeck.

2. Nature of the Service

PostDeck lets a teacher import a Google Slides presentation, add interactive activities to individual slides, and publish it as a self-paced session that students work through at their own speed using a join PIN or link. Teachers can review responses, leave feedback, export results to Sheets, Docs, or CSV, email results to students, and post or schedule the session link to Google Classroom.

3. Eligibility and authority

A teacher account must be created and operated by an adult acting on behalf of, or with the authorisation of, their school or organisation. Students join a session under the direction and supervision of the teacher who created it; PostDeck does not independently verify a student's age or identity.

4. Accounts and security

Teacher accounts are created through Google Sign-In or a verified email/password account. Where a deployment is configured to do so, account creation may be restricted to an approved email address or school domain. Teachers are responsible for keeping their account access secure and for all activity that occurs under their account, including sessions created and Google integrations authorised from it.

5. Acceptable use and user obligations

You must not use PostDeck to: collect more student information than a session genuinely needs; harass, deceive, or misrepresent participants; attempt to access another teacher's sessions, accounts, or data; circumvent plan limits, rate limits, or lock-mode/focus-loss controls; or upload or import content you do not have the right to use.

6. Student sessions and focus-loss monitoring

Students join a session using a PIN or link provided by the teacher and, depending on the session's settings, may not need a separate account. Where a teacher enables locked-down or assessment mode, PostDeck may require fullscreen, disable copy/paste and right-click, and record "focus-loss" events (for example, switching tabs or exiting fullscreen) up to a teacher-configured limit; exceeding that limit can reset the student's progress back to the start of the deck, as configured by the teacher. PostDeck cannot block every device-level action — the actual behaviour available depends on the student's browser and device — and records these events only to help the teacher run the session, not for any other purpose.

7. Imported content and user-generated content

When a teacher imports a Google Slides presentation, PostDeck reproduces that content (including slide images, text, links, and speaker notes) inside the session for the purpose of running it. The teacher remains responsible for ensuring they have the right to use and share any imported content, and for the accuracy and appropriateness of any activity prompts, feedback, or other content they add.

8. Curriculum and educational risk

PostDeck is a delivery and response-collection tool, not a curriculum or assessment authority. Teachers remain responsible for the educational appropriateness, accuracy, and curriculum alignment of any slide content or activity they publish, and for reviewing student responses before relying on them for grading or reporting purposes.

9. Student safety and appropriateness

Teachers must ensure session content and any activity prompts are appropriate for the age and context of their students, and must comply with their school's own policies on student data collection and consent, particularly where a session collects student names or school email addresses.

10. Google integrations

Features that use Google Slides, Drive, Sheets, Docs, or Classroom operate through Google's own APIs and are subject to Google's terms in addition to these. PostDeck only accesses the Google resources a teacher explicitly selects through Google's file picker, supplies through a shared presentation link, or creates through these features. Private Google resources use access tokens scoped to the relevant action; publicly shared Slides links may be read without a user OAuth token.

11. Subscriptions, fees, and billing

Paid plans (Pro and Power) are billed through Stripe on a recurring basis at the price shown at the time of purchase. Plan limits (such as maximum students per session, sessions per week, slides per deck, and access to Classroom posting or email results) apply as described on the pricing page and may change with notice. Fees are non-refundable except where required by law.

12. Suspension and termination

We may suspend or terminate access to PostDeck, including closing active sessions, if we reasonably believe these terms have been violated, to protect the security or integrity of the service, or as required by law. A teacher may stop using PostDeck and close or delete their sessions at any time from the dashboard.

13. Availability and changes

PostDeck is provided on an as-available basis. Session features depend on students' devices and network connections, which PostDeck does not control. We may modify, suspend, or discontinue features of PostDeck at any time.

14. Intellectual property

PostDeck's own software, branding, and design remain the property of TeachSmarts. Teachers retain ownership of the slide content, activity prompts, and other material they import or create, subject to the licence they need to grant us simply to host and display that content back to their students as part of running a session.

15. Disclaimer of warranties

PostDeck is provided "as is" and "as available", without warranties of any kind, express or implied, including as to merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law.

16. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to your use of PostDeck is limited to the amount you paid us in the twelve months preceding the claim, or AUD $100 if you have not paid us anything.

17. Indemnity

You agree to indemnify and hold TeachSmarts harmless from claims arising out of your misuse of PostDeck, your violation of these terms, or content you import or create within the service, to the extent permitted by law.

18. Privacy

Our collection and use of personal information is described in our Privacy Policy, which forms part of these terms.

19. Governing law

These terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law principles, unless a different governing law is required by the law applicable to your school or organisation.

20. Severability

If any provision of these terms is found unenforceable, the remaining provisions continue in full force and effect.
